1. Introduction

These Terms & Conditions (“Terms”) set out the basis on which Tundra Coldrooms (“we”, “us”, or “our”) sells any products (“Products”) listed on our website or in our most recent published catalogue to you (“the Customer”).

By placing an order with us, you agree to be bound by these Terms. Please read them carefully before ordering. If you do not agree to these Terms, you should not place an order.

All contracts with us are conducted in the English language.

2. Definitions

In these Terms:

  • “Working Days” means Monday to Friday, excluding Saturdays, Sundays, and public holidays in England when banks in London are open for business.
  • “Contract” means the agreement between you and us for the sale and purchase of Products in accordance with these Terms.

3. Order Process & Contract Formation

3.1 Orders can be placed via our website or by telephone with our customer service team. You are responsible for checking all details before submitting an order.

3.2 After you submit an order, you will receive an acknowledgment email containing your order number. This does not mean your order has been accepted.

3.3 A legally binding Contract is formed only when we issue a written Order Confirmation confirming that the order has been checked, verified, and accepted.

3.4 If we cannot fulfil your order for any reason (including stock unavailability, pricing errors, or delivery restrictions), we will inform you promptly and refund any payment made.

3.5 Customer Responsibility: Tundra Coldrooms accepts no responsibility for orders placed in error. If goods are ordered incorrectly and have already been despatched, re-stocking and carriage charges will apply.

4. Products

4.1 Product images on our website, catalogue, or brochures are for illustrative purposes only. Colours, dimensions, and specifications may vary.

4.2 The Customer is responsible for ensuring the Products ordered are suitable for their intended purpose and that there is suitable access for delivery. Orders cancelled due to Products being unsuitable for site will incur delivery and re-stocking charges.

4.3 Unless agreed otherwise in writing, unpacking, positioning, and installation are the responsibility of the Customer.

5. Prices & Payment

5.1 All prices are shown in GBP (£) and include VAT at the applicable UK rate unless otherwise stated.

5.2 If a pricing error is discovered, we will contact you for confirmation before proceeding. If we cannot reach you, the order will be cancelled, and a full refund issued.

5.3 Payment is required in full before dispatch, unless otherwise agreed in writing. We accept debit/credit cards, BACS transfer, and approved online payment methods.

6. Delivery

6.1 Upon accepting your order, we will confirm an estimated delivery date. Deliveries are completed by third-party couriers directly from our suppliers.

6.2 Standard delivery is to the kerbside at ground floor level only.

6.3 Customers must:

  • Provide correct delivery details. Incorrect addresses will incur re-delivery charges.
  • Ensure clear and safe access for delivery vehicles (18-ton vehicles unless otherwise arranged).
  • Notify us of any parking restrictions or access limitations.

6.4 Failed deliveries caused by business closure, no recipient present, or access issues will result in additional carriage charges.

6.5 All deliveries must be inspected upon arrival. Any damage, missing items, or defects must be reported within 24 hours.

7. Risk & Ownership

Risk in the Products passes to you upon delivery. Ownership passes only when payment has been received in full.

8. Cancellations & Returns

8.1 It is the Customer’s responsibility to ensure orders are correct before dispatch.

8.2 Orders cancelled after dispatch will incur re-stocking and return carriage charges.

8.3 Refunds will only be given for unused goods in original packaging, less applicable charges.

9. Warranties

9.1 Many Products come with a manufacturer’s warranty. Please refer to the documentation supplied with your Product.

9.2 For Products without a manufacturer’s labour warranty, we offer an optional paid labour warranty at the time of order.

9.3 Warranty exclusions include:

  • Fair wear and tear.
  • Misuse, negligence, or improper installation.
  • Consumable parts (bulbs, seals, shelves, baskets, trays, pans, gaskets, trims).
  • Cosmetic damage reported after 24 hours of delivery.
  • Stock loss or consequential losses from equipment failure.

10. Data Protection

We handle all personal data in accordance with our Privacy Policy, available on our website.

11. Termination

We may suspend or terminate the Contract if you fail to pay on time, become insolvent, or breach these Terms.

12. Events Outside Our Control

We are not liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to extreme weather, strikes, accidents, or transport failures.

13. Governing Law & Jurisdiction

These Terms are governed by English law. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
